This End User License Agreement ("EULA") is a legal agreement between
you ("you," "your," or "Licensee") and **Atlas Tool Shop** ("Atlas,"
"we," "us," or "our") governing your use of software, plugins, scripts,
applications, source code, downloadable tools, and other digital
software products obtained from Atlas Tool Shop (collectively, the
"Software").
By purchasing, downloading, installing, activating, accessing, or using
the Software, you agree to this EULA. If you do not agree to these
terms, do not purchase, install, activate, or use the Software.
Subject to this EULA and any product-specific licensing terms displayed
at the time of purchase, Atlas grants you a limited, non-exclusive,
non-transferable, non-sublicensable license to install and use the
Software.
Your purchase provides a license to use the Software. It does not
transfer ownership of the Software, its source code, trademarks,
branding, documentation, or other intellectual property to you.
The permitted number of users, administrators, machines, installations,
servers, or seats may vary by product and will be identified on the
applicable product page, license, or purchase record.
Where a product uses seat-based licensing, you may use the Software only
within the number of seats you have purchased.
You may not share a license, license key, activation, account, or seat
with individuals who are not authorized under your purchased license.
Additional licenses or seats may be required for additional users,
administrators, machines, installations, or other uses specified by the
applicable product.
Unless a product states otherwise, you may use properly licensed Atlas
Software:
- For personal projects.
- For commercial projects.
- For client projects where the Software is used as a development or
administrative tool.
- To create games, websites, servers, applications, content,
configurations, and other original projects.
- On the number of machines, installations, servers, or seats
permitted by your license.
- To modify supplied source code for your own permitted use when
source code is included with the product.
Use of Atlas Software in a commercial project does not give Atlas
ownership of that project.
You retain ownership of original games, websites, applications, assets,
configurations, content, and other projects you create using Atlas
Software, subject to any rights belonging to third parties whose
technology or content you use.
Atlas does not acquire ownership of your project merely because Atlas
Software was used to create, manage, build, or operate it.
Atlas retains all ownership and intellectual-property rights in the
Atlas Software itself.
Unless Atlas provides express written permission, you may not:
- Redistribute, sell, rent, lease, sublicense, or give away the
Software.
- Upload or publish the Software or its source code for public
download.
- Share purchased Software with unauthorized users.
- Share, sell, publish, or transfer license keys or activations.
- Circumvent, disable, bypass, modify, or interfere with licensing,
activation, entitlement, seat, or trial restrictions.
- Remove or intentionally obscure copyright, license, trademark, or
ownership notices.
- Repackage an Atlas product and represent it as your own software.
- Sell a modified version of an Atlas product as a competing or
derivative software product without written authorization.
- Use a single-user or limited-seat license for more users or seats
than were purchased.
These restrictions do not prevent you from distributing your own
completed projects merely because Atlas Software was used as a
development tool, provided the Atlas Software itself is not improperly
redistributed as part of that distribution.
Some Atlas products may include source code.
When source code is supplied, you may modify it for your own use within
the scope of your license.
Modification does not transfer ownership of the original Atlas code to
you and does not grant permission to redistribute, resell, sublicense,
publish, or share the original or modified Atlas Software except where
Atlas expressly permits such distribution.
Atlas may be unable to provide support for problems caused by customer
modifications.
Atlas products may integrate with or depend upon third-party software,
platforms, services, libraries, APIs, engines, or frameworks, including
technologies provided by other companies or open-source projects.
Third-party products and services remain subject to their respective
licenses and terms.
Nothing in this EULA grants you rights to third-party technology beyond
the rights provided by its respective owner.
Atlas does not control third-party products or services and cannot
guarantee their continued availability, compatibility, pricing,
functionality, or policies.
Atlas may provide updates, bug fixes, security fixes, compatibility
updates, improvements, or new versions of the Software.
Unless specifically promised as part of a product or service, purchase
of a product does not guarantee perpetual updates or support.
Changes made by operating systems, game engines, games, web frameworks,
hosting providers, APIs, third-party services, or other dependencies may
affect Software compatibility.
Atlas may make reasonable efforts to maintain supported products but
does not guarantee that every product will remain compatible with every
future version of third-party technology.
Some Software may use Atlas-operated online services for functions such
as:
- License validation.
- Product activation.
- Seat management.
- Account authentication.
- Update checks.
- Software downloads.
- API access.
- Entitlement verification.
You agree not to intentionally interfere with, circumvent, overload,
probe, or misuse these services.
Temporary interruption of an online service does not transfer ownership
rights or authorize circumvention of licensing requirements.
Atlas may provide trial versions or trial periods for certain products.
Trials may be limited by time, functionality, machine, account, server,
activation, or other reasonable restrictions.
You may not manipulate system information, accounts, machines, licenses,
or other mechanisms for the purpose of repeatedly obtaining or extending
a trial beyond its intended limits.
At the end of a trial, continued use may require purchase of the
applicable license.
You are responsible for maintaining reasonable security over your Atlas
account, license keys, activations, and authorized machines.
You should promptly contact Atlas if you believe your account or license
information has been compromised.
You may not knowingly provide another person with access to Software
that they are not licensed to use.
Purchases and refund eligibility are governed by the **Atlas Tool Shop
Refund Policy** in effect for the applicable transaction.
Nothing in this EULA is intended to eliminate rights that cannot legally
be waived under applicable consumer-protection law.
Support availability and scope may vary between products.
Support may cover installation, documented functionality, licensing
issues, and verified defects as appropriate for the product.
Support does not necessarily include custom development, modification of
customer projects, third-party troubleshooting, or repair of
customer-modified source code unless Atlas agrees to provide such
assistance.
Your license may be terminated if you materially breach this EULA,
including through software piracy, unauthorized redistribution,
intentional license circumvention, fraudulent acquisition, unauthorized
resale, or repeated sharing of licenses with unlicensed users.
Where reasonably appropriate, Atlas may provide an opportunity to
correct a violation before terminating a license.
Upon termination of a license, you must stop using the affected Software
and remove copies that you are no longer authorized to possess.
Termination does not transfer ownership of your independently created
projects to Atlas.
To the maximum extent permitted by applicable law, the Software is
provided **"as is" and "as available."**
Atlas does not warrant that the Software will be uninterrupted,
completely error-free, compatible with every hardware or software
configuration, or suitable for every particular purpose.
Nothing in this section limits warranties or rights that cannot legally
be excluded.
To the maximum extent permitted by applicable law, Atlas will not be
liable for indirect, incidental, special, consequential, or punitive
damages arising from use of or inability to use the Software, including
loss of profits, revenue, data, business opportunities, or business
interruption.
To the maximum extent permitted by applicable law, Atlas's aggregate
liability relating to a particular Software product will not exceed the
amount you paid Atlas for that product during the transaction giving
rise to the claim.
These limitations apply only to the extent permitted by applicable law
and do not exclude liability that legally cannot be excluded or limited.
The Software, Atlas branding, product names, documentation, original
source code, interface elements, and related materials are owned by
Atlas or its licensors and are protected by applicable
intellectual-property laws.
No rights are granted except those expressly provided by this EULA.
Atlas may update this EULA when necessary to reflect changes in
products, licensing systems, services, laws, or business practices.
Material changes will apply prospectively to the extent required by
applicable law. Where renewed acceptance is legally or contractually
required, Atlas may request that you accept the updated EULA before
completing a new purchase or using an affected service.
If any provision of this EULA is found unenforceable, that provision
will be enforced to the maximum extent permitted by law or modified as
necessary, while the remaining provisions will continue in effect.
Failure by Atlas to enforce a provision of this EULA on one occasion
does not waive the right to enforce that provision later.
This EULA, together with applicable product-specific license terms and
policies incorporated by reference, constitutes the agreement governing
your license to the Software.
If a product-specific license term expressly conflicts with this general
EULA, the product-specific term will control for that product to the
extent of the conflict.
Questions about licensing, activations, permitted use, or this EULA
should be submitted through the Atlas Tool Shop support system.
